Registration Terms

These Registration Terms & Rules (“Terms”) govern your registration and use of TLCDesk.com (“TLCDesk”, “we”, “us”). By creating an account or using TLCDesk, you agree to these Terms and our Privacy Policy and Site Guidelines.
1. Eligibility
You must be at least 13 years old (or the minimum age required in your jurisdiction).
You must provide accurate account information and keep it up to date.
You are responsible for all activity under your account.
2. Account Security
You must keep your login credentials confidential.
You may not share or sell your account.
Notify us immediately if you believe your account is compromised.
3. Community Content (Your Posts, Uploads, Messages)
You retain ownership of the content you post, but you grant TLCDesk a license to host and display it.
By submitting content to TLCDesk, you grant us a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to use, host, store, reproduce, modify (for formatting/display), publish, publicly display, and distribute your content as necessary to operate and promote the Services, including backups, caching, and content delivery.
This license ends when your content is deleted from TLCDesk systems, except:
where content has been shared with others and they have not deleted it,
where retention is required for legal, security, moderation, or dispute reasons,
where technical limitations require limited backup retention.
4. Content Rules
You agree not to post, upload, transmit, or otherwise make available content that:
Violates the Site Guidelines
Is unlawful, defamatory, harassing, hateful, threatening, or invasive of privacy
Includes personal data (doxxing) or sensitive identifiers (license numbers, plate/VIN tied to a person, home address, etc.)
Infringes intellectual property rights
Contains malware, phishing, or harmful code
Constitutes spam or deceptive promotions
5. Marketplace, Services, and Transactions
If TLCDesk allows marketplace-style posts (rentals, services, classifieds), you understand:
TLCDesk is not a party to private transactions between users.
You are solely responsible for your listings, claims, compliance, taxes, licensing, and disputes.
TLCDesk does not verify users, listings, TLC compliance, vehicle condition, or pricing unless explicitly stated.
We may remove listings or require verification at our discretion.
6. Paid Features (If Offered)
If TLCDesk offers subscriptions or paid services:
Payments may be processed via Stripe and/or PayPal.
Prices, renewal terms, and benefits will be described at purchase.
Unless required by law, fees are non-refundable once a billing period starts, except as required by our written refund policy (if any) or by applicable law.
Chargebacks or payment abuse may result in suspension/termination.
7. Moderation Rights
TLCDesk may moderate content and enforce these Terms at its discretion, including:
removing/editing content,
issuing warnings,
restricting features,
suspending or terminating accounts.
We do not guarantee that all rule-breaking content will be caught immediately.
8. Termination
We may suspend or terminate your access to TLCDesk:
for violations of these Terms or Guidelines,
to protect the community,
for legal compliance,
for security or operational reasons.
You may stop using TLCDesk at any time and request account deletion (see Privacy Policy).
9. Disclaimers
TLCDesk provides a community platform and does not provide legal, tax, financial, insurance, or TLC regulatory advice.
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”
We disclaim all warranties to the fullest extent permitted by law, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
10. Limitation of Liability
To the maximum extent permitted by law:
TLCDesk and its owners, operators, employees, and affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages.
Our total liability for any claim arising out of or relating to the Services will not exceed the greater of (a) USD $100 or (b) the amount you paid us in the 12 months before the event giving rise to the claim.
Some jurisdictions do not allow certain limitations, so these limits may not apply to you.
11. Indemnification
You agree to defend, indemnify, and hold harmless TLCDesk and Xponzy Tech LLC from claims, damages, losses, and expenses (including legal fees) arising from:
your content,
your use of the Services,
your violation of these Terms,
your violation of any rights of another party.
12. Governing Law & Venue
These Terms are governed by the laws of the State of New York, without regard to conflict of law rules.
You agree that any dispute will be brought in state or federal courts located in New York, unless otherwise required by applicable law.
13. Changes
We may modify these Terms at any time. We will update the Effective Date. Continued use of TLCDesk means you accept the updated Terms.
